THE STATE MUST TAKE RESPONSABILITY TO ERADICATE INFORCED DISAPPEARANCES OF FRANCO

Fernando Magan is a lawyer. Since years ago he collaborates with collectives related to the historical memory recuperation trying to find the ways to make justice act searching for the disappeared under Franco’s repression. On December the 14th 2006, on the same day the Historical Memory Law was being discussed at the Congress for first time, he presented a lawsuit, besides other lawyers, at the National Court. That day was the duty judge Baltasar Garzon, one of the premier world court seeking justice for the disappeared. After a year and a half in which they have added several complaints from groups and individuals, the Court has made his move, had requested information from the Defense and Interior ministries and demanding associations to assess the possibility of an instruction. His performance was echoed very limited therefore we decided to do this interview about a fact that may be crucial to our history.

How to start the complaints procedure?

A number of groups from different regions we had plenty of time evaluating this possibility. And what pushed us to take a further step was the knowledge of the proposed law of Historical Memory by Government to Parliament in the summer of 2006. After studying it we understood that it did not match even with international humanitarian law, the State had no responsibility to repair with minimal rigor disappearances. The law intended to support families by local institutions and called on the public administrations but it set up in an official manner something that the associations were doing already.

We must not forget that once in 1978 our Constitution was endorsed, everything remained the same, the same people occupying the same positions, they or their descendants, the running of the 80’s and 90’s did not change anything, just the face, society was corseted and immovable in their old values ​​and are still doing the same but with another glaze.

Even today many of those involved are still alive, they or their descendants still determined to run a veil around the facts that by themselves would be enough to awake the conscience of the rest of the Spanish, if it did not happen that prestige, power and money is at stake.

We do not need a facelift, we need to clean up many stained names, many damned consciences and many disturbed souls, no need to change the collar to the same dog, we need to have it suppressed, because .........¿ who is giving back their lives to so many desperate mothers? Who is giving me my life back, the one I should have had but had not? Who is bringing me back to the delivery room at the Hospital and letting me stay with my child? WHO?
